Is Temu a scam? Temu is a real online marketplace, but that does not make every seller, product, discount or message using its name trustworthy. The practical questions are what you are buying, who is selling it, and what happens if the order goes wrong.
Quick verdict: We would not describe Temu as simply a fake store. We would also not give it an unconditional safety endorsement. Official enforcement actions document concerns about seller transparency and unsafe products; returns and promotions have conditions worth checking before paying.

Is Temu a legitimate company?
The FTC identifies Whaleco, Inc. as the operator of Temu. Temu’s U.S. privacy policy also identifies Whaleco Inc., a Delaware company. There is an identifiable business behind the marketplace.
That answers the company-identity question. It does not establish that a particular listing is accurate, that a branded item is authentic, or that a seller’s product meets applicable safety standards. Judge the specific item as well as the platform.
What have regulators actually found?
U.S.: seller disclosures and reporting tools
In September 2025, the FTC announced a proposed settlement with a $2 million civil penalty over alleged INFORM Consumers Act violations. The allegations concerned inadequate ways to report suspicious marketplace activity and missing or insufficiently prominent information about certain high-volume sellers, including in gamified listings.
Those are specific consumer-protection allegations. They are not a finding that every Temu seller is fraudulent or that every purchase fails.
EU: illegal-product risk assessment
On May 28, 2026, the European Commission announced a €200 million DSA fine. It found that Temu had not adequately assessed the risks of illegal products on its platform. Testing cited by the Commission found substantial safety problems among selected chargers and baby toys, including electrical, chemical and suffocation hazards.
This EU finding deserves attention, but it is not a test of every product sold worldwide. Our recommendation: for a charger, baby product or other item where failure could cause injury, require a traceable manufacturer and credible, product-specific safety information. A low price and good star rating are not sufficient checks.
Temu returns and refunds: the U.S. rules to check
Temu’s return policy, updated September 17, 2026, states:

Start in Your Orders → Return/Refund. Use the supplied return label, not the parcel’s sender address. Keep the drop-off receipt. Eligibility and inspection can affect the outcome.
Are Temu free gifts and huge discounts real?
A promotion can exist while its headline leaves out conditions that matter to you. Before participating, identify the required spending, referral conditions, deadline and whether the reward is merchandise, credit or a coupon with further restrictions. If you cannot work out the total commitment, skip the offer.
The EU Consumer Protection Cooperation Network notified Temu in November 2024 of practices it assessed as unlawful, including misleading discounts, pressure tactics, inadequately disclosed game conditions and concerns about reviews. The Commission’s current summary describes that action as ongoing. This is separate from the 2026 DSA fine.
Compare the final checkout price with an equivalent product elsewhere. A crossed-out reference price does not, by itself, establish a bargain.
Does Temu collect personal information?
Yes. Its U.S. privacy policy describes collecting account, purchase, payment, device and shopping-activity information, along with approximate location derived from technical information such as an IP address. It describes sharing necessary order information with merchandise partners and says those partners do not receive payment information or device data.
These disclosures justify reviewing your privacy choices; they do not, by themselves, prove that the app steals bank credentials. Review device permissions, advertising preferences and notification settings. Using the website avoids installing the app, but the website still collects data under the policy.
What to do about a bad order or suspicious Temu message
- Open Temu independently. Compare the message with your actual order history instead of signing in through an unexpected link.
- Document the issue. Save the listing, seller name, order confirmation, photos, tracking and support responses.
- Request a specific remedy. Explain whether the item is missing, damaged, different from the listing, or an unauthorized purchase. These are different problems.
- Escalate promptly if unresolved. Ask your card issuer about a dispute and its deadlines. A platform’s return window does not necessarily preserve your payment-dispute rights.
The FTC’s online-shopping guidance recommends credit-card payment when possible, keeping records and checking sellers beyond star ratings. Suspected deceptive practices can also be reported through ReportFraud.ftc.gov.

Is Temu a scam or a real shopping site?
It is a real marketplace. That does not guarantee every seller or product is trustworthy. Consider the documented regulatory concerns and evaluate the particular listing before buying.
Is everything on Temu unsafe or counterfeit?
No such blanket conclusion follows from the evidence reviewed here. The European Commission documented serious problems with selected products; that warrants caution without treating every item as identical.
Can I get a refund from Temu?
Eligible purchases can qualify under the published policy. Check your item’s deadline, exclusions and refund destination; approval is not automatic.
Are Temu free gifts guaranteed?
Check the exact offer’s conditions before participating. A promotional headline is not enough to determine eligibility or what you must do to receive the reward.
Does using Temu prove my financial information was stolen?
No. A privacy concern, unwanted advertising or an unfamiliar message does not establish theft. If you see an unauthorized transaction, contact the payment provider promptly and investigate the actual charge.
Does a Temu logo make an email or text genuine?
No. Open your account independently and check the claimed order or offer there. Treat a request for sensitive information through an unexpected link as unverified.
